ShortFlix Terms of Service

Welcome to the ShortFlix website and/or mobile application (collectively, the “Platform”). ShortFlix is an online platform administered and managed by AI Cortex Nexus Limited and its subsidiaries and affiliates (individually and collectively, “ShortFlix”, “WE”, “US” or “OUR”), facilitating the viewing, purchase, and other interactions with short dramas and related content. These Terms of Service govern your rights and obligations as a user of the Platform. By accessing or using the Platform, you acknowledge and accept these Terms of Service and any other specific rules, procedures, terms, and conditions specified in the respective item’s pages, which may be amended by ShortFlix at any time at its sole discretion.

1. Definitions

In these Terms of Service, the following words and expressions shall have the following meanings unless the context otherwise requires:

•                               Account: means your account duly registered with ShortFlix to facilitate your use of the Services available on the Platform.
•                               Content: means any short dramas, related media, and other materials made available on the Platform.
•                               Intellectual Property: means all copyrights, trademarks, service marks, brand names, logos, copyrighted information, and other intellectual properties belonging to the corresponding owners/publishers/developers and/or ShortFlix.
•                               Item(s): means any goods, products, or services made available for sale or use on the Platform.
•                               Legal Age: means the age at which an individual can legally enter into contracts in the jurisdiction in which they reside.
•                               Parties: means collectively, ShortFlix and you, and “Party” shall mean any one of them.
•                               Platform: means collectively, the web Platform presently known as ShortFlix.com and the ShortFlix mobile application, and such other web and/or mobile platforms administered and managed by ShortFlix.
•                               Services: means any services provided by ShortFlix through the Platform, including but not limited to the viewing of short dramas.
•                               Terms of Service: means these Terms of Service governing the use of the Services by you, as may be amended from time to time at ShortFlix’s sole discretion.

2. Licence to Use

In consideration of your agreement to these Terms of Service and your continuing observance and compliance with them, ShortFlix hereby grants you a non-exclusive, non-transferable licence to access the Platform and use the Services upon the terms and subject to the conditions stated herein.

3. Representations and Warranties

You represent and warrant that:

•                               You have read, understood, and consented to these Terms of Service.
•                               Your personal information and the documentation submitted in this respect, including but not limited to your full name, telephone number, correspondence address, and email address, are true and accurate. You shall promptly notify us in writing of any changes in your personal information.

4. User ID and Account

You are responsible for maintaining the confidentiality of your User ID, password, and Account information. You are solely responsible for any activities that occur under your Account.

5. Use of Services

Your use of the Services is subject to these Terms of Service. You agree not to use the Services for any illegal or unauthorized purpose. ShortFlix reserves the right to terminate or suspend your Account and access to the Services if you violate these Terms of Service.

6. Goods & Services

All Content and Items reflected on the Platform are granted to you on a limited and revocable licence basis. The value of any Items reflected in your Account does not represent any credit value in real currency and cannot be exchanged for real money.

7. Availability of Services

The Services are usually available on a daily basis unless otherwise specified. ShortFlix may, at its sole discretion, charge a fee for the maintenance of your Account if you do not utilize the Services for a continuous period of twelve (12) months.

8. DISCLAIMERS, EXCLUSIONS, AND FORCE MAJEURE

You agree and confirm that you shall not hold ShortFlix, its employees, agents, or licensees, liable for any special, incidental, or consequential damages arising out of or in relation to the Services or these Terms of Service. To the fullest extent permitted by applicable law, ShortFlix shall not be liable for any loss or damage of any kind incurred as a result of the use of or reliance on any Content or Services provided on the Platform.

9. Intellectual Property Rights

All proprietary Content and Intellectual Property displayed on the Platform are the exclusive property of ShortFlix and, where applicable, third-party proprietors. No right or licence is granted directly or indirectly to any party accessing the Platform to use or reproduce any Intellectual Property.

10. Reliability of Platform

You are aware that all transactions and interactions conducted on the Platform are through telecommunication and data networks. You accept that your receipt of notifications from ShortFlix and vice versa may be delayed or prevented by factors affecting the relevant service providers and other relevant parties.

11. Account Security

You are responsible for maintaining the security of your Account. ShortFlix is not responsible for any unauthorized access to your Account.

12. Disclosure of Information

ShortFlix may disclose your personal information to third parties as required by law, to enforce these Terms of Service, or to respond to your requests for customer service. ShortFlix will not disclose your personal information to any other party without your consent, except as otherwise permitted by these Terms of Service.

13. Applicable Laws and Indemnity

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which AI Cortex Nexus Limited is incorporated, without regard to conflict or choice of law principles. Any dispute arising out of or in connection with these Terms of Service shall be submitted to the jurisdiction of the courts of that jurisdiction. You agree to indemnify and hold harmless ShortFlix from any and all claims, liabilities, losses, damages, and expenses arising out of or relating to your violation or breach of these Terms of Service or any applicable laws.

14. Suspension, Termination, and Cancellation of Services

ShortFlix may cancel the Services or any part thereof at any time without prior notice to you. Upon cancellation, the Services may be reinstated in such manner and on such terms as ShortFlix may determine at its sole discretion. You may deactivate your Account at any time by following the instructions provided on the Platform. ShortFlix may terminate your Account and access to the Services if you violate these Terms of Service or any applicable laws.

15. Notices

All notices, demands, requests, or other communications to be given or made under these Terms of Service shall be in writing and shall be sufficiently given or made by serving such notice at or sending such notice by hand, registered post, or electronic mail to the contact details as notified by one party to the other.

16. Waiver and Severance

Any failure by ShortFlix to enforce any provision of these Terms of Service at any time or for any period shall not be a waiver of that provision or the right to enforce it at any time subsequently. If any provision of these Terms of Service is declared invalid or unenforceable by any judicial or other competent authority, ShortFlix may amend that provision in such reasonable manner as would achieve its intention or sever it from these Terms of Service, and the remaining provisions shall remain in full force and effect.

17. Variation

These Terms of Service may be modified, added to, deleted, or varied by ShortFlix by way of posting on the Platform or in any such other manner as ShortFlix may determine at its sole discretion. You agree that continued use of the Services shall constitute your acceptance of these Terms of Service (as modified and varied from time to time).

18. Assignment

You may not assign your rights under these Terms of Service without the prior written consent of ShortFlix.

19. Binding Effect

These Terms of Service shall be binding on your heirs, personal and legal representatives, estate, successors-in-title, and permitted assigns (where applicable).

By accessing or using the ShortFlix Platform, you acknowledge and accept these Terms of Service.
